This is the privacy policy (“Privacy Policy”) that explains how Rooster, LLC (“Rooster”) and our affiliated companies collect, protect, use, and disclose Personal Data (defined below) in connection with your use of our website located at app.rooster.com and any other website or mobile application that we operate (each, together with its sub-domains, content and services, collectively the “Site”) and our products, including the Rooster tracking device (the “Products”) (collectively the Site and our Products are referred to as the “Services”).

By using or accessing the Services, continuing to access the Services, or submitting any information through the Services, you are consenting to the information collection and use practices described in this Privacy Policy, as modified from time to time by us, as described below. Your use of the Services are also governed by the Terms of Use located at [app.rooster.com/terms]. You may choose whether or not to provide or disclose certain Personal Data in connection with your use of our Services. If you choose not to provide certain Personal Data we request, you may still visit and use parts of our Services but may be unable to access or use certain features, options, programs, and services.

1.  Introduction

We are committed to respecting privacy and recognize the need for appropriate protection and management of any Personal Data that is shared with us as part of using our Site. As used in this Privacy Policy, "Personal Data" means any information that may be used, either alone or in combination with other information, to personally identify an individual.

We reserve the right, at our discretion, to change the terms of this Privacy Policy at any time. You can see when this Privacy Policy was last updated by reviewing the “Last Updated January 2022” legend on the top of this page. We normally will not notify you of any such changes by email or other personal contact, but we reserve the right to do so. UNLESS OTHERWISE INDICATED, ANY CHANGES TO THIS PRIVACY POLICY WILL APPLY IMMEDIATELY UPON POSTING TO OUR SITE.

3.  Personal Data Collected.

3.1  Personal Data You Provide On Our Site.

Types of Personal Data. We and our service providers may collect, store, and use any information or Personal Data you submit through the Site or the Services including, but not limited to, your name, email address, address, company name, job title, phone number, and communications you send to us.

Contact Information. In various areas of our Site and in printed materials, we provide you the opportunity to submit a form with basic contact information, such as your name, email, phone number or mailing address. With your permission, Rooster uses such information to inform you of new products, technical information and services, and upcoming events that may be of interest. If you no longer wish to receive these emails, the opt-out process is described in Section 7.2 of this Privacy Policy.

In addition, if you choose, you may participate in a Rooster e-mail list server by subscribing within our Site or by contacting Rooster staff directly. You may unsubscribe from these e-mail list servers by following the unsubscribe instructions found within the list email.

Personal Data You Disclose Relating To Others. If you disclose any Personal Data relating to other people to us or to our service providers in connection with our Site, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

Information Provided To Third Parties. Please note that we use certain third-party service providers on our Site to enhance your experience or deliver certain services. Social Media. We have worked with certain third-party social media providers to offer you their social networking services through our Services. For example, you can use third-party social networking services, including but not limited to Facebook, LinkedIn, Google+, and others to share information about your experience on our Site with your friends and followers on those social networking services. These social networking services may be able to collect information about you, including your activity on our Site. These third-party social networking services also may notify your friends, both on our Site and on the social networking services themselves, that you are a user of our Site or about your use of our Site, in accordance with applicable law and their own privacy policies. If you choose to access or make use of third-party social networking services, we may receive information about you that you have made available to those social networking services, including information about your contacts on those social networking services.

Our Site provides Social Media Features (“Features”), such as the Facebook Like button, and widgets such as the “Share” button or interactive mini-programs that run on our site (“Widgets”). These Features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the Feature to function properly. Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features and Widgets are governed by the privacy policy of the company providing it.

3.2 Information Collected and Generated By The Products

We and our service providers may collect, store, and use any information or other Personal Data that is collected or generated by any Product and transmitted to the Services. The Products, including the Rooster tracking device, collect information which could, under certain circumstances, include information about your location or the location of other persons. The Products are used to track the location of the objects to which the Products are attached. If a Product is attached to equipment or other property you are using, the Product may collect information about you, including your geographic location.

If you place a Product on any object or piece of equipment, you are responsible for ensuring that Rooster can generate and collect the data transmitted from the Product under applicable laws. By placing a Product on an object or piece of equipment, you grant, and represent and warrant that you have the right to obtain such information, and also the right to grant Rooster the right to collect the location data and other information collected from the Product.

3.3 Information We Collect From Third Parties

We may collect information about you from third parties, such as public databases, joint marketing partners, social media platforms (including from people with whom you are friends or otherwise connected) and from other third parties. In addition, if you elect to connect your social media account to our Site, certain Personal Data from your social media account will be shared with us, which may include Personal Data that is part of your profile or your friends’ profiles. We may aggregate any information about you collected from any source.

3.4. Information Collected Automatically.

Whenever you interact with our Site, we automatically receive and record information from your browser or device. Information collected automatically may include the date and time of your visit, the length of your visit, the specific webpages you visited, your IP address, your geographic location, the type of web browser and operating system used, the address of any website that directed you to the Website, and information about your mobile device used to access the Website (including phone number, operating system details, and any applicable unique identifiers for you or your device, including your device’s Unique Device Identifier (UDID), any Apple or iOS identifiers (e.g., IDFA or an Advertising Identifier), any Google or Android identifiers (e.g., Android or Google Advertising ID), any Windows identifiers (e.g., Windows Advertising ID), or any other similar identifiers which identify you or your device). We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. We have a legitimate interest in using such information to assist in log-in, systems administration purposes, information security and abuse prevention, to track user trends, and to analyze the effectiveness of our Site. Cookies. We use cookies to make interactions with our Site easy and meaningful. When you visit our Site, our servers may send a cookie to your computer. We may use cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer. Targeting or Advertising cookies 

From time-to-time, we may engage third parties to track and analyze usage and volume statistical information from individuals who visit our Site. We sometimes use cookies delivered by third parties to track the performance of our advertisements. For example, these cookies remember which browsers have visited our Site. 

By way of example, as you browse our Site, advertising cookies may be placed on your computer so that we can understand what you are interested in. Our advertising partners then enable us to present you with retargeted advertising on other sites based on your previous interaction with our Site. 

We also contract with third-party advertising networks and similar partners that collect IP addresses and other information from web beacons (see below) on our Site, from emails, and on third-party sites. Ad networks follow your online activities over time by collecting Site Navigational Information through automated means, including through the use of cookies. Third parties, with whom we partner to provide certain features on our Site or to display advertising based upon your web browsing activity, use Flash cookies to collect and store information. Other Tracking TechnologiesWhen you visit our Site, we may collect your IP address for certain purposes such as, for example, to monitor the regions from which you navigate our Site. We may also use web beacons alone or in conjunction with cookies to compile information about your usage of our Site and interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular site tied to the web beacon. For example, we may place web beacons in marketing emails that notify us when you click on a link in the email that directs you to our Site. We may use web beacons to operate and improve our Site and email communications. 

Analytics Software Tools. We use Google Analytics on our Site to help us analyze the traffic on our Site. 4.  The Purposes for Which We Use Personal Data

We may use the collected Personal Data or other data described above, individually or in the aggregate, for any lawful purpose, including, but not limited to, (i) to provide our Site and Services, including collecting and displaying the information collected by the Products (ii) to analyze, administer, and improve our Site and Services; (iii) to contact you in connection with our Services, notifications, events, programs or offerings that you may have registered for, (iv) to send you updates and promotional materials, (v) to identify and authenticate your access to the parts of our Site and Services that you are authorized to access; (vi) for recruiting and human resources administration purposes, and (vii) to protect our rights and/or our property and to ensure the technical functionality and security of our Site. 

If you do not provide certain Personal Data we request, we may not be able to provide you with our Services.

5.  How We Disclose Personal Data

Except for the limitations expressly discussed herein, if any, we may disclose, sell, or transfer any collected information to third parties for any lawful purpose in our sole discretion. 

5.1. Our Third-Party Providers. We employ third party service providers to perform tasks on our behalf and to assist us in providing our Services, such as credit card processing, marketing, and web hosting. During the course of providing us with these services, these third parties may have access to your Personal Data and other information in order to provide the services we requested from those third parties.

5.2. In the Event of Merger, Sale, or Change of Control. We may transfer or assign this Privacy Policy and any Personal Data to a third-party entity that acquires or is merged with us as part of a merger, acquisition, sale, or other change of control. 

5.3. Disclosures to Users. As described above, the Products, including the Rooster tracking device, collect information which could, under certain circumstances, include information about you or other persons. The Products are used to track the activity and location of the objects to which the Products are attached. If a Product is attached to equipment or other property you are using, the Product may collect information about you, including acceleration, pitch and geographic location. The user who registered a particular Product will be able to log into the Services and obtain information collected by the Product, which may include information about the activity and location of particular objects or equipment.

5.4. Affiliates and Marketing. We may disclose your collected information to Rooster’s affiliated entities. We may also disclose your information to third parties for marketing purposes. These affiliates and third parties may contact you via any method of contact you provide to Rooster. We may use third-party service providers to provide us with advertising, conversion tracking, or similar services. These service providers may have access to information gathered by cookies or other similar mechanisms.

5.5. Other Disclosures. We may disclose Personal Data about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our terms of use, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of Rooster, our users, or the public.

6.  Rentention of Personal Data

We reserve the right to retain any Personal Data as long as the Personal Data are needed to: (i) fulfill the purposes that are described in Section 4 (The Purposes For Which We Use Personal Data) in our discretion, or (ii) comply with applicable law or our internal recordkeeping purposes. We may retain the Personal Data and other information described above after you delete your account or have ceased using the Services. However, Rooster does not guarantee that any information will continue to be available after such deletion or cessation.

7.  Your Rights

7.1 Personal Data. You may have certain rights regarding your Personal Data under applicable law. If you would like to access, amend, erase, export (i.e., data portability), object to, or restrict the processing of your Personal Data collected via our Site, you may submit a request to info@rooster.com or write to us at:

We will promptly review all such requests in accordance with applicable laws. 

7.2. Opting Out of Promotional Emails. You may choose not to receive future promotional or advertising emails from us by selecting an unsubscribe link at the bottom of each email that you receive from us, or by responding to the emails directly and requesting removal if such a link is not available. Additionally, you may send a request specifying your communications preferences to info@rooster.com. Customers cannot opt out of receiving transactional emails related to their account with us or our services. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any "Contact Us" request as well as administrative, maintenance and operational emails (for example, in connection with a password reset request).

8. Jurisdiction and Cross-Border Transfer.

The Site is controlled and operated by us from the United States and is not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your Personal Data may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Site you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Data.

9.  Data Security

The security of Personal Data is important to us. We follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Data, we cannot guarantee its absolute security.

10.  Children's Privacy

Our Site is not intended for children under the age of 18. Accordingly, we do not intend to collect Personal Data from anyone we know to be under 18 years of age.

11.  How We Respond to Do Not Track Signals

Rooster does not currently respond or take any action with respect to web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Data about an individual consumer's online activities over time and across third-party websites or online services.

12. Your California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of Personal Data about you by Rooster to third parties for the third parties’ direct marketing purposes. Our Site may contain links to third-party websites and services that are not owned or controlled by Rooster. We are not responsible for the privacy practices or the content of third-party websites, services and advertisements, and you visit them at your own risk.
