Terms & Conditions Age Requirements The Guest represents to the Agent that: 1) The guest is of 25 years of age or older and will be an occupant of the Dwelling during the entire term of this rental agreement. 2) Additionally, the individual signing this rental agreement (referred to as the "signing lessee" in Paragraph 7) represents to the Agent that he/she will be an occupant of the Dwelling during the entire term of this rental agreement and that he/she meets the aforementioned age requirements. Cancellation Policy Cancellation of a reservation less than 60 days prior to arrival date will result in the loss of all funds unless we are able to rebook the property for the same rate and dates. If reservations are cancelled prior to the 60-day cancellation, guest will be charged the booking fee and guest will be charged 15% of the total room-rental rate. All cancellations are subject to administrative fees. Any changes in properties or dates must occur 60 days prior to arrival. CHECK-IN TIME IS 4:00 pm. Plan to arrive in your home no earlier than 4:00 pm. Do not use the house pool/spa before 4:00 pm on the check-in day. WE MAKE EVERY EFFORT TO ENSURE YOUR HOME IS READY AT 4:00 PM, BUT WE CANNOT GUARANTEE. CHECK-OUT TIME IS 10:0 am. This is a must due to logistics of turnover. Keys must be brought to our office upon departure. Cleaning When booking a Home for 4 nights or less a housekeeping fee will apply. A reservations agent will contact you with 24 hours of booking with fee amount and payment options. Damage Waiver The damage waiver includes accidental breakage or damage to rental unit up to a liability limit of $2,500. Damage must be reported by the guest before departure. Damage not reported by guests will not be covered by damage waiver, and guest will be responsible for expenses incurred. Guest agrees to surrender property in the same condition as at commencement of the rental period. In cases of abuse and malicious damage to rental property, guest will reimburse Agent and/or Owner the amount of all damage including reasonable attorney's fees. Early Check Out/No Show Policy THERE WILL BE NO REFUNDS FOR EARLY CHECK OUTS OR NO SHOWS - Guest agrees that once they have checked into the property, no refund will be made for early check outs. If guest does not cancel the reservation and does not arrive for the Guest's rental period, all monies paid will be forfeited. Fireplaces/Garages Fireplace and garage use varies from home to home. Most fireplaces are decorative only, and some garages are used for owner storage. General Policies This agreement constitutes a contract between the guest and property manager, Agent for the Owner of the property. Please read carefully, sign and return one copy within 10 business days. Homes/Villas Neither property manager nor owner shall be responsible for providing any additional furnishings or equipment not available presently in the residence. It is understood that each property and its furnishings are privately owned and property manager acts as the sole Agent for the Owner. Please do not remove items from the property or change the location of furniture that belongs to the rental unit owner. If furniture is moved, you will be responsible for any charges incurred in returning it to its proper location. Hurricane Policy PLEASE READ CAREFULLY - Agent will not issue any refunds for hurricane evacuations or any other natural disasters. Guest may purchase travel insurance through property manager which will cover mandatory hurricane evacuations and all other natural disasters. Indemnification of Agent by Guest Guest agrees to indemnify and save Agent, its employees and Agents, free and harmless from any claim or liability for any loss or damage whatsoever arising from, related to or in connection with rental of the Dwelling, including but not limited to any claim or liability for personal injury or damage or loss of property which is made, incurred or sustained by any Guest or any Guest's invitee. Length of Stay Monthly Rentals are not offered during Vacation Season. Stays over 14 nights cannot be issued online. Month long rentals will be accepted during all other seasons. Monthly reservations do not include a reservation fee. Lost and Found Lock all doors when you leave your accommodations. Do not leave money or valuables unattended in the unit; neither Agent nor the owner will be held accountable or liable for any thefts. Thoroughly check all drawers and closets before departing. Agent only returns left behind items upon request by UPS or US Postal Service at the Guest's expense. Minimum night stay When booking a Home for 4 nights or less a housekeeping fee will apply. A reservations agent will contact you with 24 hours of booking with fee amount and payment options. Non-Smoking All properties with are Smoke Free. Violations will incur additional cleaning costs and penalties. Minimum penalties for smoke damage start at $500.00. Occupancy The Guest agrees not to exceed the maximum occupancy allowed by this property as described on the front of this lease (babies in cribs are not included). Person signing the contract must occupy the premise the entire length of stay. Property manager does not rent to minors. [Please see Penalty for Violation of this Agreement as outlined below.] Parking Parking is not allowed on streets, construction sites or bike paths. Gated communities do not allow campers, motor homes, motorcycles, boats and boat trailers and recreational vehicles. Penalty for Violation of this Agreement If Guest violates any of the conditions or restrictions of this agreement, the Guest agrees that the Agent may terminate this agreement and enter the Dwelling. Upon notice of termination of the agreement, the Guest shall vacate the dwelling immediately without being entitled to any refund and shall waive any rights that may be applicable under South Carolina landlord-tenant act. Pet Policy PETS ARE NOT PERMITTED IN OUR HOMES AND VILLAS OR ON PREMISES. This policy will be strictly enforced. If you are found in violation of this Policy, the Agent reserves the right to immediately cancel your rental reservation and occupancy of the Dwelling. Additionally, Guest will forfeit all monies for the balance of their stay and incur a minimum additional penalty of $250. Pool Access Additional fees will be charged for pool and spa heats for the months of September - May. Please call for rates as they vary per property. Please note that we are no longer able to provide last minute pool heats. Last minute is considered 7 days or less prior to arrival. Prohibited Vehicles Parking is not allowed on streets. Gated communities do not allow campers, motor homes, motorcycles, boats and boat trailers and recreational vehicles. Property Availability In the event that the Owner of the privately owned dwelling makes the dwelling unavailable, or should the dwelling be undergoing any major repairs, Agent shall be held harmless by Guest. Agent will make every effort to move guests to comparable accommodations at the original rate. If comparable accommodations are not available, the guest agrees to accept a full refund of any monies paid. Rates All reservations that are made for any future year are not guaranteed. Agreements with the property owners are made in the fall of the current year for the next year. Rates and or the property could change. Guest will be notified if there is a property or rate change by no later than the beginning of the year that their reservation is current. Guest may cancel within a set time period (set by the company) without cancellation penalties if they do not wish to accept the new rate or property. Rates are quoted on a weekly basis. A nightly rate will be 1/5 of the weekly rate. A minimum of three nights is required with all properties. During the Vacation season, rentals are required to be a minimum of a week and from Saturday to Saturday. Nightly rentals will be accepted within a 30 day period of your stay. Please call the office to inquire for nightly rentals during the prime seasons. Company has the right to cancel and not honor any reservation made over the internet that may not fall under these guidelines. Please note: Some owners may require a minimum of a week's stay all year round. Rates do not include pool or spa heat during the months of September - May these services can be ordered for an additional charge. Rental Balance and Signed Contract Balance of rental monies is due 60 days prior to arrival for homes and 30 days prior to arrival for villa properties. Exact date is located next to final balance. While there may be numerous occupants in a given dwelling, only the reserving party is required to sign the lease. The agent will hold the signing lessee responsible for the payment and other lease holder responsibilities enumerated in the lease. Repairs Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Property manager uses the best maintenance personnel available on the Island. Problems are corrected as soon as humanly possible. Agent or an authorized employee or repairman may enter the premises during business hours for any purpose connected with the repair, care or maintenance of the premises. Refunds will not be issued due to malfunctioning equipment or other guest dissatisfaction. Hilton Head is a highly desirable developing resort area with houses under construction. We do not move people or give refunds due to construction noise. You can expect a courteous and professional attitude toward problem solving. Returned Checks A $25 service charge will be levied on any returned checks. Travel Delay/Cancellation Property manager offers travel insurance. It can protect you for losses you may incur because of unforeseen circumstances, illness, injuries and even mandatory evacuation. The cost of this insurance is 6% of the rental rate plus 5% SC sales tax. Travel insurance must be purchased at the time of reservation booking to cover any pre-existing medical condition. Insurance can be purchased until 30 days prior to arrival or until final payment is made - which ever comes first. All refunds are paid directly by the insurance company. Use Any use of the dwelling other than residential use during a family vacation must be approved by the Agent. If the dwelling is to be used for any event such as weddings, receptions, "parties" or large gatherings, the Guest agrees to submit a request for approval to the Agent and adhere to the Agent's determination on that request. If the Agent approves the event, the Guest may be required to pay an additional deposit. If the Guests misrepresents an event to the Agent (said misrepresentation to be determined by the Agent), the Guest agrees that the Agent may refuse occupancy or have the dwelling vacated and that the Guest will not be entitled to any refund.
